 May 2025 (Vol. 20, Issue 4)

Dear Paddocks Press Fans

South Africa has seen a notable increase in the number of community schemes in the past few years. The industry is expanding at a rapid rate! We’re grateful to have been around for three decades, from Prof. Graham Paddock and his early associates to today’s Paddocks’ team that includes both generations. What hasn’t changed over the years is our desire to educate and equip people to effectively manage these schemes, and to do this using modern technology, such as our latest Next Gen Learning initiative that incorporates AI-tutoring.

Our Next Gen Learning courses have been so well received that we have a number of new short courses under construction, so if you’re interested, watch this space!

While we have new courses to offer, our popular, thorough, tried and tested traditional online courses continue to equip and upskill hundreds each year. This week we started our next round of these three courses:

  • Sectional Title Scheme Manager
  • Home Owners’ Association Scheme Manager
  • Advanced Sectional Title Financial Management Masterclass

Because the courses are online and completed one module at a time, it’s not too late to register. The deadline is Friday 9th May at 5pm.

Please email info@paddocks.co.za if you would like to register before the deadline this Friday.

Jennifer Paddock

PADDOCKS SHEDS LIGHT ON CURRENT ISSUES

Debunking the “Structural” Misconception in Sectional Title Schemes

A common misunderstanding about sectional title schemes is that if a building issue is "structural" in nature, it automatically falls under the body corporate's responsibility. Under the STSM Act, whether an issue is structural or not is irrelevant when determining responsibility for maintenance, repairs, and costs.

Subsidence of Sectional Title Dwellings: Part 2 - A Case Study and Legal Analysis

This follow-up article explores the procedural and legal steps available to a sectional title unit owner when in respect of foundations subsiding and consequent damage an insurance claim is repudiated, and the body corporate refuses to accept liability. It provides a synthesised case study and legal analysis, offering insights into effective dispute resolution in sectional title schemes.

Understanding Body Corporate Borrowings and Levy Insurance

A sectional title body corporate might sometimes need to borrow funds to fulfil its statutory functions or exercise its powers. This article explores situations where borrowing may be necessary, the legal framework governing borrowings, available types of security, the practical pros and cons, and the emerging practice of levy insurance.
